Welcome to CarSponsorships.com. THE FOLLOWING DESCRIBES THE TERMS UNDER WHICH CARSPONSORSHIPS.COM OFFERS YOU ACCESS TO ITS SERVICES. The terms "service" and services", as used throughout our website and this agreement, refers to sponsorships and or internet services. You must be at least 16 years old to become a CarSponsorships.com Client and/or use any CarSponsorships.com services. In addition, before you can become a CarSponsorships.com Client and/or use the CarSponsorships.com Web site, if you are between the ages of 13 and 17, inclusive, you must obtain permission from your parent or guardian. By submitting your online application, you are entering into an agreement with CarSponsorships.com to secure you a sponsorship from one or more of its participating partners.
If you want to become a CarSponsorships.com Client, please review this Terms of Service Agreement. The terms "sponsorship" and sponsored", as used throughout our website and this agreement, refers to full and/or quasi-sponsorships. By registering to become a CarSponsorships.com Client, clicking on the "Submit Application" button and/or otherwise using the CarSponsorships.com Web site you agree to the terms, conditions, notices and guidelines contained in this Terms of Service Agreement and, where applicable, you represent that you have obtained permission from your parent or guardian.
Please be advised that we may amend this Agreement at any time by posting the amended terms on our site. The amended terms shall be automatically effective immediately after they are initially posted on our site. This Agreement may not otherwise be amended except in a writing signed by both parties. This Agreement was last revised on January 09, 2007.
CarSponsorships.com is a sponsorship placement agency who negotiates and secures sponsorships for its Clients. These sponsorships range from full, quasi and perk sponsorships as outlined below in section 2 and 3. The terms "sponsorship" and sponsored", as used throughout our website and this agreement, refers to full and/or quasi-sponsorships. All of our sponsorships have been pre-negotiated and are made available to all applicants who successfully submit their online application, however, we have the right to refuse a sponsorship to anyone and at anytime. Our current sponsor partners and their sponsorship offers can change or be discontinued at anytime. CarSponsorships.com never guarantees a full or quasi-sponsorship and we will never charge you if we don't get you sponsored. We also have the right to stop or cease an existing Clients sponsorship if we feel that the individual is causing harm, not promoting their sponsor or for any other reason. Regardless of your car or condition, advertised sponsorships are yours once application payment is made and 72 hours have elapsed. However, if it's determined (within the 72 hour review period), that the sponsorships advertised by CarSponsorships.com are no longer available we have the right to reject your application and void your transaction. No fees are ever incurred if your application is declined.
A CS "full sponsorship" also referred to as the "RTF Sponsorship" and the "RPM Sponsorship" is where you the car enthusiast will be provided with free products once you have promoted your sponsor at multiple shows by handing out flyers and other promotional materials. For more information on these full sponsorship programs, please review the information outlined below.
The Road To Full Sponsorship (RTF) gives certain approved Clients the ability to receive participating RTF sponsors products for free. Some sponsors require shipping to be paid. The RTF Program requires you to attend local car shows, take pictures, hand out sponsor literature and submit a show report to us verifying your attendance. Once we receive the show report your sponsor will ship out your free sponsored products. Some sponsors may have additional requirements. Must be an active CarSponsorships.com Pro Level Client to participate.
Approved RTF Applicants must follow these guidelines:
1. Submit a hard copy portfolio to CarSponsorships.com
2. Portfolio contents must be provided inside a report cover, and returned to CarSponsorships within 10 Days of the start of your membership.
3. Pictures – Print the pictures on gloss paper, or have them developed and laminated. You should have no more than 3 pictures on one page, and no more than 3 pages of pictures. Make sure you take high quality pictures of the interior, exterior, and engine bay. Each picture must be at least 3" x 5" and no bigger than 4" x 6".
4. Current and Future Modifications – Make sure you have details from the companies you already have products from; Example: Kyowa KR228 18" Wheels- Not : 18" wheels or; 18s
5. Future Show Listing – This section should be dedicated to the shows you are going to this year. Remember these are shows you already have planned out. If you have shows you are tentatively going to please include this information Example: Hot Import Nights – Example City, 2/3/2007
6. Biography on you and your vehicle – This should be no more than 2 paragraphs or half of a page. This section is where you get to explain your life and the automotive industry. Remember to include information on other cars you might have done, previous experience and show history.
Once we receive your portfolio we will review the documents and if your package is approved CarSponsorships.com will send you a RTF package that includes promotion items for you to hand out at shows as outlined below:
1. Your first step is to apply the sponsor decals on your vehicle. Please take photos of the decals on your vehicle. The CarSponsorships.com decal (Approximately 30") needs to be applied to the windshield of the vehicle. If you can not apply it to the windshield because of local laws or you have a pre-existing sponsor in that place, please apply it to the rear window. Please take photos of the decals on your vehicle. The Sponsors decal (Approximately 30") should be placed on the rear window. Exceptions can be made by calling a CarSponsorships.com Sponsorship Advisor. Please take photos of the decals on your vehicle.
2. The next step is to attend a car show. Please remember that any show you attend must have at least 75 cars entered. Exceptions can be made by contacting your Sponsorship Advisor at least 14 days prior to the show.
3. Hand out 1 flyer to each car entered into the show (please try and hand them out to car owners that might be in the need for a new body kit). Do not place the flyers directly on the show car! Hand it to the owner of the vehicle. Take at least 5 pictures of you handing out the flyers to the different vehicle owners. We will verify by contacting random owners that have entered into the show.
4. Get a business card or flyer from each and every vendor at the show. We must have one from each. We will verify that these vendors were at the show.
5. Hand out any remaining flyers to attendees of the show. Do not place the flyers on vehicles that are in the parking lot!
1. Create a show report. The report should include highlights of the show, the name of the show, date, who won trophies, a contact number for a show representative, etc.
2. Include the vendor's business cards and flyers that you collected at the show.
3. Include the photographs that you took at the show (be sure to include photos of you handing out flyers).
4. Also include the photographs of the sponsor's decals on your vehicle.
5. Your report should include your full name, address, phone number, email address, and portfolio ID number.
6. Label your package with the stage of the RTF program you are submitting for.
All packages are to be sent to CarSponsorships.com mailing address. Once RTF steps are approved and CarSponsorships.com determines that Client has successfully completed the program, sponsored products will be shipped. Additional steps may be necessary to complete the RTF Program. Please contact a Sponsorship Advisor at 1-239-274-5552 for complete RTF guidelines and requirements.
This RPM program was developed to assist current Clients as they strive to obtain a guaranteed opportunity of full reimbursement and, as of Oct 16 2007, current Clients that participate in and complete the RPM Program, will be reimbursed up to 100% (fully sponsored) by CarSponsorships.com for all products purchased through Clients sponsor.
1. Purchase any product or products (no minimum) from your sponsor or sponsors within 90 days of your sponsorship start (the date your application was submitted). **Also within 90 days of your sponsorship start you must submit the RPM Entry Form (available to you once you become a current Client) if you plan on participating in this RPM Program. You will need to send the form to us via UPS, FedEX or USPS Express Mail.
2. Install these products on your car along with 2 of your sponsor's decals (provided by your sponsor when your products arrive).
3. Send us pictures using this form RPM Install Picture Form (available to you once you become a current Client) verifying installation and decals on vehicle. Please follow instructions on form.
4. Enter your car at your local show with at least 100 cars entered within 12 months of start of sponsorship. If you are entering your car into a local car show to qualify for the HIN RPM then you will need to contact us to get your CarSponsorships.com stickers. Don't forget we need to pre-approve the show, so don't delay, get us the info on the show ASAP.
5. Win just 1 of the trophies available (1st, 2nd or 3rd) within 12 months of the start of your sponsorship.
6. Send us 3 pictures using this form RPM Winning Trophy Picture Form (available to you once you become a current Client) showing that you won a trophy. Please follow instructions on form. These photos must be clear because your sponsor will use them for press releases. You must be present and pictures must be taken at the night of show the trophy was won. Pictures must include sponsors decals being displayed with the trophy.
7. Once these requirements are met, and CarSponsorships.com verifies the trophy, you will be reimbursed by check. Please allow at least 4-5 weeks for reimbursement check.
Maximum payout per vehicle/Client is $2500 annually; $1,000 per sponsor annually. Products ordered must be installed correctly and must be operational. (Note: We have the right at anytime to change the qualifying categories for the RPM program. We also maintain the right to disqualify anyone for any reason.)
A "Turn Your Car Into A Show Car" sponsorship is a sponsorship program where you, the driver/owner of the car will receive a series of pre-negotiated sponsorships that assist you in turning your car into a show car by allowing you to obtain products for free or at a special discounted rate. Free products may require Clients to pay for shipping. Sponsorships awarded are based on availability. Turn Your Car Into A Show Car applicants will have the opportunity to be selected for the dream package at one of the H.I.N. shows. All Turn Your Car Into A Show Car sponsorships have been pre-negotiated and are made available to all applicants who successfully submit their online application, however, we have the right to refuse a sponsorship to anyone and at anytime.
A "quasi-sponsorship" is when you are not given money, but your sponsor provides you with the ability to purchase certain products at cost. The majority of our sponsors will first award submitted applications with a quasi-sponsorship. As a quasi-sponsored Client, you can use your sponsorship as a stepping stone to gain other sponsors. You are responsible for installation of all products obtained through the quasi-sponsorship. Some sponsors may opt to pay for you to install products but it is the sole discretionary decision of your sponsor. The majority of the time you will need to install them yourself or have a professional install them for you.
CarSponsorships.com works with a variety of automobile companies and creates, manages and services sponsorship programs. By submitting your online application, you agree that CarSponsorships.com has the right to run such sponsorship programs in a manner and with such frequency that is subject to change. Sponsorship offers from our sponsor partners may end without notice and CarSponsorships.com can end any sponsorship contract with sponsor and/or sponsored Client at any time and for any reason. Your dealings with the sponsor and their promotions found on or through the service, including payment and delivery of related goods or services are solely between you and the sponsor, although all communications between you and sponsor must be handled through CarSponsorships.com. You agree that CarSponsorships.com should not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such sponsors participating in the CarSponsorships.com sponsorship program.
When you click on submit, we AUTHORIZE_ONLY your card and DO NOT PLACE A CHARGE at the time of submission. Some credit card companies may show a hold for the $89 application fee. Once reviewed by a CarSponsorships.com Agent and the sponsorships as outlined in our terms and conditions are secured in your name, will we automatically process your credit card for the application fee and send you an email with your sponsorship information, including your sponsors name, product information and any other information you will need to start your sponsorship. Regardless of your car or condition, advertised sponsorships are yours once application payment is made and 72 hours have elapsed. However, if it's determined (within the 72 hour review period), that the sponsorships advertised by CarSponsorships.com are no longer available we have the right to reject your application and void your transaction. No fees are ever incurred if your application is declined. When you submit your application, we receive it immediately regardless of the credit card authorization outcome. The application fee covers your account set-up, sponsorships and portfolio.
You agree to indemnify and hold CarSponsorships.com, and its parents, subsidiaries, affiliates, officers, other partners, and employees, harmless from any claim, demand or damages, including reasonable attorney's fees, made by any third party due to or arising out of your content, your use of the sponsorship, your connection to the service, your violation of the sponsorship, or your violation of any rights of another.
CarSponsorships.com provides its services on a commercially reasonable basis and does not guarantee that Clients and/or users will be able to access or use the services at times or locations of their choosing. Specifically CarSponsorships.com reserves the right at any time to modify or discontinue temporarily the service (or any part of the service) with or without notice. You agree that CarSponsorships.com should not be liable to you or to any third party for any modification, suspension or discontinuance of the service.
Sponsors may or may not be directly owned by CS and are legitimate businesses operating via the Internet, via Mail Order Catalogues, or via "brick and mortar" traditional storefronts. CS is not obligated but will put forth its best effort to find additional sponsorship and quasi-sponsorship opportunities for you. CS will also provide you with industry specific information from time to time that will be designed to increase your level of professionalism.
We do not promise you that we will secure additional car sponsorships throughout your 1 year term but we will put forth our best effort to get you as many sponsorships as possible. You will not be charged for additional sponsorships obtained throughout the year. We only charge for our services initially when your application is reviewed.
We do not pre-screen sponsors in any way. You ASSUME ALL RISK regarding any car sponsorship. Our liability is limited to the total amount of the fees that you pay us for our services. You agree to hold us harmless regarding any claim of any nature arising from your sponsorships or quasi-sponsorships including any car accidents, traffic tickets, injuries, car shows incidents while operating your car, loss or damage to your vehicle, loss of employment, and injury to yourself or any other person and any claims of product liability.
You agree not to reproduce, duplicate, copy, sell, rent, resell or exploit any portion of the sponsorship you are awarded, use of the service or access to the service.
Once sponsored, your Client status is active for 12 months from the date your application is submitted. Clients may terminate or cancel their membership and/or sponsorship(s) at anytime and do not have to participate in any sponsorship offers but no refunds are given for any reason.
CarSponsorships.com reserves the right to change its fees or billing methods at any time, in case CarSponsorships.com changes its fees or billing methods notice will be provided at least thirty (30) days in advance by email and/or by posting a notice on the CarSponsorships.com Website.
By submitting your online application, you are entering into an agreement with CarSponsorships.com to secure you a sponsorship from one or more of its participating partners. Regardless of your car or condition, advertised sponsorships are yours once application payment is made and 72 hours have elapsed. However, if it's determined (within the 72 hour review period), that the sponsorships advertised by CarSponsorships.com are no longer available we have the right to reject your application and void your transaction. No fees are ever incurred if your application is declined.
If you are a Pro Level subscriber, you cancel your Pro Level by logging into your carsponsors.com client area and clicking on Profile Information or email billing@carsponsorships.com.
If for some reason we are unable to secure a sponsorship, you will not be charged. Your card WILL NOT BE CHARGED unless you are awarded a sponsorship from at least one or more or our partners as listed or displayed on our website. We have the right to change or add participating sponsors at anytime. You are responsible for all charges incurred with your sponsorship, including product installation, show fees, apparel and any other items you may need to promote your sponsor. Many of our sponsors provide you with promotional items for free or at a minimal cost.
By submitting Content (photo's, media articles, trophies, schedules, portfolios, etc) to CarSponsorships.com, whether by mail delivery, email or site uploading, you grant CarSponsorships.com the world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the Content solely for the purpose of displaying, distributing and promoting your CarSponsorships.com/CarSponsors.com Portfolio and/or for CarSponsorships.com to use in their media advertising. This license exists for as long as you continue to be a CarSponsorships.com Client and shall be terminated when you request from us by email that your content be removed and you have received confirmation from CarSponsorships.com of the removal of your content. You also represent that you have full power and authority to comply with this Terms of Service Agreement without violating the rights of others and agree that your use of CarSponsorships.com and its services will comply with this Terms of Service Agreement without violating the rights of others.
a) THE CLIENT AGREES THAT THE USE OF THIS SITE IS ENTIRELY AT THE CLIENT'S OWN RISK. THE SITE IS PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND. ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS, ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW. CARSPONSORSHIPS.COM ALSO DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS AND PERFORMANCE OF THE SITE TO THE FULLEST EXTENT PERMITTED BY LAW. CARSPONSORSHIPS.COM DISCLAIMS ANY WARRANTIES FOR OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE SITE, AS WELL AS FOR ANY INFORMATION OR ADVICE RECEIVED THROUGH THE SITE, OUR STAFF OR THROUGH ANY LINKS PROVIDED IN THE SITE. NEITHER CARSPONSORSHIPS.COM NOR ANY THIRD-PARTY CONTENT PROVIDER MAKES ANY WARRANTY WITH RESPECT TO ANY CONTENT, INFORMATION, SERVICES, OR PRODUCTS PROVIDED THROUGH OR IN CONJUNCTION WITH THE SITE.
(b) CARSPONSORSHIPS.COM MAKES NO IMPLIED OR EXPRESS REPRESENTATIONS OR WARRANTIES ABOUT THE RELIABILITY, OR ACCESSSIBILITY OF THE CLIENT PAGES OR THE ASSOCIATED STORAGE FACILITIES. CARSPONSORSHIPS.COM IS NOT RESPONSIBLE FOR ANY DAMAGE CAUSED BY LOSS OF ACCESS TO, DELETION OF, FAILURE TO STORE, FAILURE TO BACK UP, OR ALTERATION OF CLIENTS PORTFOLIOS OR APPLICATIONS. INDIVIDUAL CLIENTS ARE RESPONSIBLE FOR MONITORING AND CREATING BACKUPS OF THEIR PORTFOLIO'S.
UNDER NO CIRCUMSTANCES SHALL CARSPONSORSHIPS.COM BE LIABLE TO ANY USER ON ACCOUNT OF THAT USER'S USE OR MISUSE OF THE SITE OR RELIANCE ON THE SITE. CARSPONSORSHIPS.COM DOES NOT GUARANTEE THE LEGITIMACY OR IDENTITY OF ANY USER, INCLUDING ANY PROFESSIONAL CLIENT, OR OF ANY INFORMATION OR ADVICE PROVIDED ON CARSPONSORSHIPS.COM, INCLUDING ANY INFORMATION OR CONTENT PROVIDED BY SPONSORS OR ANOTHER THIRD PARTY. CARSPONSORSHIPS.COM DOES NOT GUARANTEE THAT ANY USERS OR CLIENTS, INCLUDING SPONSORS, WILL USE THE CARSPONSORSHIPS.COM WEBSITE PROPERLY OR IN COMPLIANCE WITH THE TERMS AND CONDITIONS APPLICABLE TO THEM. CARSPONSORSHIPS.COM DOES NOT GUARANTEE THAT ANY CLIENT WILL SUCCESSFULLY OBTAIN A CONTRACT, EMPLOYMENT OR SPONSORSHIP OF ANY KIND AS A RESULT OF MEMBERSHIP IN OR USE OF CARSPONSORSHIPS.COM. YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH CARSPONSORSHIPS.COM IS THE CANCELLATION OR THE TERMINATION OF YOUR USE OF CARSPONSORSHIPS.COM. SUCH LIMITATION OF LIABILITY SHALL APPLY TO PREVENT RECOVERY OF DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE AND EXEMPLARY DAMAGES (EVEN IF CARSPONSORSHIPS.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SUCH LIMITATION OF LIABILITY SHALL APPLY WHETHER THE DAMAGES ARISE FROM THE USE OR MISUSE OF THE SITE OR RELIANCE ON THE SITE, FROM INABILITY TO USE THE SITE OR FROM THE INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SITE OR SERVICES OFFERED ON THE SITE (INCLUDING SUCH DAMAGES INCURRED BY THIRD PARTIES). SUCH LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE SITE OR RECEIVED THROUGH ANY LINKS PROVIDED ON THE SITE. SUCH LIMITATION SHALL APPLY, WITHOUT LIMITATION, TO THE COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOST PROFITS, OR LOST DATA. SUCH LIMITATION SHALL APPLY WITH RESPECT TO THE PERFORMANCE OR NON-PERFORMANCE OF THE SITE OR ANY PRODUCTS, SERVICES, INFORMATION, OR MERCHANDISE THAT APPEARS ON, OR IS LINKED OR RELATED IN ANY WAY TO, THE SITE. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. SUCH LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. Any disputes regarding this site will be handled by mandatory binding arbitration, in the State of Florida. The laws of the State of Florida shall apply.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Florida without regard to conflicts of laws provisions. You and CarSponsorships.com agree that Lee County, Florida, USA shall have exclusive jurisdiction over any dispute between you and CarSponsorships.com relating in any way to the CarSponsorships.com service or Web site or these Terms and Conditions. You and CarSponsorships.com expressly and irrevocably consent to personal jurisdiction and venue in these courts. The parties agree that in any such dispute or subsequent legal action, they will only assert claims in an individual (non-class, nonrepresentative) basis, and that they will not seek or agree to serve as a named representative in a class action or seek relief on behalf of those other than themselves.
